It cannot be overstated that in recent times the gravity and complexity of irregular maritime migration have triggered concerns and debates in the academic domains of International Relations and International Law. The article examines how states’ compliance with, and enforcement of, international law and legal norms would tackle the challenges of irregular migration in the Indian Ocean region. The legislative and policy challenges regarding irregular migration can be analyzed under two segments. First, there is a lack of comprehensive discussion about (...) the sending and the receiving states’ commitments (regarding irregular migrants) to international law and legal norms. Secondly, deficit of comparative analysis to show how the littoral states comply with international law norms on migration and refugee influx. Such analysis from multiple perspectives would be helpful to get insights and make policy recommendations about how effectively international law norms could be enforced through national legislation and policy framework. Water is regarded as indefeasible necessity of human civilization. In the South Asia region, the groundwater resource is poised as essence of life, security and development. Bangladesh is not an exception from that. Due to scarcity as well as disproportionate availability of surface water supply, the groundwater resource is veered into vital source to undergird heavy demand of water supply for livelihoods, industrial and agricultural purposes. Considering these, the groundwater resource governance is crucial since it is the mainstay of upholding (...) economic, social and development rights; failure to ensure proper governance would only drag the country into the tentacles of environmental scourge, conflict and food insecurity. The paper endeavors to analyze the role and significance of civil society on groundwater resource management. It explores the nature of challenges that civil society is encountering during its engagement with groundwater resource governance. This paper undertakes to outline national legislative and policy response to groundwater resource management in Bangladesh. It also scrutinizes in detail of groundwater resource aspect in international law and would reveal that, considering the gravity of the issue, both the domain of international law and national law contribute below the par to the issue. The paper further contends that existing legislative and policy structure of Bangladesh eventually maims the civil society from contributing and bars it to facilitate effective participation of the commons. In the concluding remarks, the paper highlights suggested recommendations stemming from discussions, observations and policy reports to bolster the affiliation of civil society in the governance of groundwater resource. Background and objectives: Bangladesh has the highest malnutrition rates in the world. The main objective of this study is to identify and determine the main factors for child malnutrition among children under the age 5 years in rural Bangladesh. -/- Material and methods: This research was conducted in rural areas at Meherpur district in Bangladesh. Convenience sampling method is used and 85 under 5 child information is collected through a structured questionnaire. The information’s of child’s are gathered from the mothers (...) of the child. Malnourished children is measured by using APLS method and WHO Child Growth Standard Median Index. Binary logistic regression model is used to find out the key factors of malnutrition. -/- Results: It is found that family income, maintain proper diet during pregnancy period, proper diet maintain for children have negative significant (p<0.05) effect on child malnutrition. -/- Conclusion: The magnitude of the child’s malnutrition still is of great concern in Bangladesh. Since, poverty, imbalanced diet during pregnancy period and imbalanced diet for under 5 children influences to malnutrition are significantly associated with high prevalence of malnutrition, so government and people should reduce these factor to reduce malnutrition in rural area of Bangladesh. Thought is the primary realm in which truth and falsity may occur and speech the secondary realm of this occurrence while the realm of external being has no truth and falsity in itself. The first and last points are directly asserted by Aristotle in one text: ‘Falsity and truth are not in things-it is not as if the good were true, and the bad were in itself false- but in thought.’ (Met., E, 1027b25-27; cf. Met., K, 1065a22-23) The second point (...) is also somehow implied: ‘As there are in the mind thoughts which do not involve truth and falsity, and those which must be either true or false, so it is in speech.’ (OI, I, 1, 16a9-11) 1) Truth and falsity belong only to co-positings and positing aways and not to incomposites Truth and falsity do not belong to the realm of external being but only to the realms of thought and language. However, they do not belong to all the elements in these realms. Neither do they belong to incomposite elements in thought (‘With regard to simple things and essences, falsity and truth do not exist even in thought.’ (Met., E, 1027b26-28; So., Γ, 6, 430a26-b4)), nor to such elements in language. Consequently, all incomposites are incapable of being true or false. (cf. Met., Θ, 1051b17-22 and b26-27) Where we have no co-positing or positing away, of the kind made by copula or verb, we cannot have truth and falsity though we can have significance: ‘“Man” and “white”, as isolated terms, are not yet either true or false. In proof of this, consider the word “good-stag.” It has significance, but there is no truth or falsity about it, unless “is” or “is not” is added, either in present or in some other tense.’ (OI., I, 1, 16a14-18) Therefore, any other kind of co-positing cannot be the subject of truth and falsity. One good example of co-positings not made by copula or verbs are simple negations: ‘He that uses the expression ‘not-man,’ if nothing more be added, is not nearer but farther from making a true or a false statement than he who uses the expression “man.”’ (OI., I, 10, 20a34-36) It is indeed a co-positing or a positing away that is the subject of truth and falsity: ‘For it is co-positing (σύνθεσιν) and positing away (διαίρεσιν) that truth and falsity is about.’ (OI., I, 1, 16a12-13) Co-positing is so vital for truth-falsity that ‘of the things that are never said based on co-positing, nothing is true or false.’ (Cat., 10, 13b9-11) This co-positing can be both in thought (‘where the alternative of true or false applies, there we always find a sort of combining of objects of thought in a quasi-unity … For falsehood always involves a combining’ (So., Γ, 6, 430a26-b2) and ‘truth or false is a co-positing of concepts of thought’ (So., Γ, 6, 430a11-12) and in language because they are produced in thought: ‘There is not only the true or false assertion that Cleon is white but also the true or false assertion that he was or will be white. In each and every case that which unifies is thought.’ (So., Γ, 6, 430b4-6) 2) Correspondence to external world Although truth and falsity belong to thought and language and not to external world, their basis is in the external world. It is, in fact, the correspondence of thought and language to external world that makes what is true, true and what is false, false: ‘To say of what is that it is, or of what is not that it is not, is false, while to say of what is that it is, and of what is not that is not, is true.’ (Met., Γ, 1011b26-27; cf. Met., Θ, 1051b2-5) When the two realms are correspondent, we can transfer from one to the other: ‘If it is true to say that a thing is white, it must necessarily be white; if the reverse proposition be true, it will of necessity not be white. Again, if it is white, the proposition stating that it is white was true; if it is not white, the proposition to the opposite effect was true. And if it is not white, the man who states that it is making a false statement, it follows that it is not white.’ (OI., I, 9, 18a39-b3) This possible mutual transformation does not, however, imply that each realm is the basis of the other. In fact, it is only the external world that is the basis of truth and falsity in thought or language and not vice versa: ‘it is not because we think that you are white, that you are white, but because you are white we who say this have the truth.’ (Met., Θ, 1051b6-9; Cat., 5, 4b8-10) Aristotle even calls the external world the ‘cause’ of truth in the realm of language while the converse causation is not approved: ‘Whereas the true statement is in no way the cause of the actual thing’s existence, the actual thing does seem in some way the cause of the statement’s being true: it is because the actual thing exists or does not that the statement is called true or false.’ (Cat., 12, 14b18-22) This one-sided relation Aristotle calls ‘reciprocation as to implication of existence’: ‘For there being a man reciprocates as to implication of existence with the true statement about it: if there is a man, the statement whereby we say that there is a man is true, and reciprocally- since if the statement whereby we say that there is a man is true, there is a man. And whereas the true statement is in no way the cause of the actual thing’s existence, the actual thing does seem in some way the cause of the statement’s being true: it is because the actual thing exists or does not that the statement is called true or false,’ (Cat., 12, 14b14-22) Aristotle attaches falsity to not-being: ‘We cal things false in this way, then, either because they themselves do not exist, or because the appearance which results from them is that of something that does not exist.’ (Met., Δ, 1024b24-26) Or: ‘A false formula is the formula of non-existent objects, in so far as it is false.’ (Met., Δ, 1024b26-27) This correspondence to ‘non-being’ is, however, more a miscorrespondence: ‘Hence every formula is false when applied to something other than that of which it is true, e.g. the formula of a circle is false when applied to a triangle.’ (Met., Δ, 1024b27-28) . هدف از پژوهش حاضر، بررسی مسائل اخلاق هوش مصنوعی در حوزۀ هنر است. به‌این‌منظور، با تکیه بر فلسفه و اخلاق هوش مصنوعی، موضوعات اخلاقی که می‌تواند در حوزۀ هنر تأثیرگذار باشد، بررسی شده است. باتوجه‌به رشد و توسعۀ استفاده از هوش مصنوعی و ورود آن به حوزۀ هنر، نیاز است تا مباحث اخلاقی دقیق‌تر مورد توجه پژوهشگران هنر و فلسفه قرار گیرد. برای دست‌یابی به هدف پژوهش، با استفاده از روش تحلیلی‌ـ‌توصیفی، مفاهیمی همچون هوش مصنوعی، برخی تکنیک‌های آن و موضوعات (...) اخلاقی هوش مصنوعی در هنر تبیین و بررسی شده است. نتایج پژوهش نشان می‌دهد موضوعات اخلاقی همچون حریم خصوصی و نظارت، دستکاری در رفتار، تاری و شفافیت، سوگیری در تصمیمات سیستم، و اتوماسیون و اشتغال حوزۀ هنر قابل‌بررسی است. این موضوعات اخلاقی، گاهی درتقابل و گاهی در ارتباط مستقیم و هم‌سو با یکدیگر قرار دارند. بررسی‌ها نشان می‌دهد پاسخ به پرسش‌های اخلاق هوش مصنوعی در حوزۀ هنر، نیازمند پاسخ به پرسش‌های اخلاقی به‌صورت عام در هوش مصنوعی است. The aim of this paper is to explore the ethical implications of artificial intelligence (AI) in the realm of art. Drawing on the philosophy and ethics of AI, this study examines the ethical challenges that may arise in the art domain. Given the increasing use and penetration of AI in the field of art, there is a need for more careful attention to the ethical dimensions of this phenomenon by scholars of art and philosophy. To achieve the objective of the paper, concepts such as AI, some of its techniques, and the ethical issues of AI in art are explained and analyzed using the analytical-descriptive method. The findings of the study reveal that ethical issues such as privacy and surveillance, manipulation of behavior, opacity and transparency, bias in decision systems, and automation and employment can be investigated in the field of art. These ethical issues are sometimes in conflict and sometimes in direct relation with each other. This study suggests that addressing the ethical questions of AI in the field of art requires addressing the ethical questions of AI in general. (shrink)

This essay briefly evaluates the ongoing controversy between LIU Qingping and GUO Qiyong (and their followers) about the “moral heart ”of Confucianism in order to draw acomparison with Islamic ethics for mutual illumination of the two traditions.

Aristotle has repeatedly stated in his works that 'being has several senses'. Is this to be regarded as his pluralistic ontology, an approach that seems to be too nascent? If so, how can this newfound approach in ontology be linked to the ideas of the father of this science, i.e. Aristotle? These are the questions that the present article seeks to answer. First, we will show that Aristotle thinks of 'being' in four senses. Then, step by step he proceeds to (...) leave different senses aside, insofar as only one sense remains: being in the sense of the figures of the categories. We argue, then, that it is better to found Aristotle's ontological pluralism upon the fourfold sorts, instead of the tenfold categories. We will provide some reasons for this preference, i.e. in defense of the fourfold sorts and against the tenfold categories. Each of these four modes of being will be discussed. Finally, a version of ontological pluralism will be provided and attributed to Aristotle: Sorting Version. According to this version of pluralism, we will demonstrate how Aristotle speaks of the ontologically fundamental structure of the world. (shrink)

One way to compare different theoretical approaches to the study of technologies is to see what the difference is between their narratives of the construction of a particular technology. In this paper, we re-narrate the bicycle construction from the perspective of actor-network theory (ANT), comparing to SCOT’s first account of the construction. Although SCOT has moved closer to actor-network theory later by paying more attention to co-construction and materliaty, Pinch and Biker have not modified their account of the bicycle development (...) according to these theoretical changes, despite the fact that one decade later Bijker allocated one chapter, ‘king of the road’, to Safety bicycle development again. An ANT’s narrative of bicycle development can provide a basis for a concrete comparison between ANT and the classic version of SCOT. Or it could be argued that this narrative could complement the story of Pinch and Biker of bicycle development. While we present a new narrative of bicycle development in comparison with SCOT’s one, we offer a methodological framework in the ANT literature that can be considered as a methodological procedure to the study of artefacts in general; this framework has three elements: 1. Phenomenal Bracketing, 2. Collective construction, and 3. Co-construction. (shrink)

Understanding the policymaking process in an emerging economy in the global south, such as Bangladesh, holds significant importance. The country's remarkable socio-economic development, once the most impoverished in the region, has been facilitated by post-globalization economic transformation. While the literature on institutional change has predominantly focused on states in industrialist countries, this dissertation presents an innovative theoretical approach. It deeply explores primary case materials to illustrate how the state engages in policy evolution in a developing country's gradual shift from the (...) import substitution model towards globalization and deregulation. The central argument posited is that Bangladesh's globalization, particularly through its private sector-led garment exports, stands as a significant success story. Bangladesh is now the world's second-largest garment exporter after China. This achievement is attributed to the entrepreneurial development it fosters and its role in driving socio-economic change. Moreover, it has enabled the mobilization of resources, reducing aid dependence, enhancing climate resilience, improving public health and wellbeing, empowering women, and addressing critical needs in physical infrastructure and human development. The argument presented here diverges from the conventional explanation found in the literature, which tends to emphasize the role of external forces, particularly institutions like the World Bank, the International Monetary Fund, and donors, in triggering policy reforms in Bangladesh. These reforms, commonly linked with structural adjustment packages implemented during the balance of payments crisis, are frequently perceived as predominantly influenced by external pressures. Additionally, the influence of the business class or Bangladeshi non-governmental organizations (NGOs) is often asserted. This dissertation proposes an alternative explanation by suggesting that ideational viewpoints within the state, specifically the ideas espoused by top technocrats and political executives, played a significant role. It argues that these internal ideational factors were more influential than materialistic ones, highlighting the causal role of the policy process driven by endogenous imperatives. The introduction of the dissertation addresses the research problem and research puzzle while suggesting conjectures after problematizing existing arguments. The significant economic transformation observed in Bangladesh today is portrayed as the outcome of a gradual process spanning several decades. The transition towards promoting the private sector and embracing globalization commenced in 1991, following a series of incremental changes dating back to the 1970s and 1980s. During these periods, the institutional path progressed towards empowering the private sector and embracing globalization, laying the groundwork for a trajectory led by the private sector in the context of globalization. The theory chapter serves to establish the conceptual and theoretical foundation for analyzing both economic change and transformation by examining the evolutionary nature of the process. The study adopts an institutional change framework, drawing on the theory of gradual change and focusing on concepts such as layering and tipping points. Within this framework, causal variables such as powering and puzzling, social learning, and ideas are identified. The methodological approach is grounded in historical institutionalism, employing the process-tracing "within case" method. The selection of cases deliberately targets an important yet under-researched area—the policy process in Bangladesh concerning the success of garment-led industrialization. This dissertation fills a noticeable gap in the literature through rigorous analysis, enabling an in-depth exploration of the institutional dynamics spanning four governments from 1972 to 1991. The study relies on substantial primary materials, including interviews with key officials. Each empirical chapter not only presents data but also connects the findings to conceptual and theoretical conjectures, underscoring the significant contributions of this research. The key causal variables identified include the concepts of ‘puzzling’ and ‘social learning’ within the state capacity framework, along with a narrowly defined and developed concept of a "policy committee." The learning process entails technocrats engaging in what Hugh Heclo and Peter Hall term as "social learning," where they play a crucial role in addressing policy challenges, particularly during times of uncertainty and political turmoil, based on their learning from past experiences. Additionally, the concept of ‘powering’ is highlighted, emphasizing that while technocrats provide policy recommendations, it is ultimately the political executive who endorses policies. The interplay between ‘puzzling and powering’ and ‘social learning’ shapes the outcomes of the policy process. The first empirical chapter focusing on the Sheikh Mujibur Rahman Government (1972-1975) illustrates the emergence of policy learning during this period. Initially, this government pursued import substitution under strict government controls, with a predominant public sector. The historical context of exploitation under Pakistani rule and the centralization of industry by West Pakistan fostered socialism as an ideal for East Pakistan's economic emancipation. Additionally, close ties with India and the Soviet Union reinforced this socialist tendency. However, due to severe economic conditions resulting from stringent control on private investment and emphasis on large-scale public investment, policy puzzling and learning ensued. As a result, incremental changes were initiated, allowing limited private sector participation. The second empirical chapter explores the General Ziaur Rahman government's tenure (1975-1981) and how deregulation was consolidated within a layering step, paving the way for a shift towards globalization. General Zia and his technocrats, operating under authoritarian conditions, acknowledged the inefficacy of existing policies. Furthermore, General Zia's inclination towards the West fostered closer collaboration with donors. The Multifiber Agreement (MFA) presented an opportunity for garments, coinciding with the decline in jute exports. This government opened up industrial sectors for private participation, and banks provided funding across various sectors, with special emphasis on the burgeoning garment industry. The chapter also explores the origins of the garment industry during this period. Notably, Noorul Quader Khan, upon retiring as cabinet secretary, collaborated with a Korean multinational, Daewoo, with the support of General Zia, leading to the establishment of Desh Garments—a pioneering venture that catalyzed the export orientation of the sector. The third empirical chapter delves into the economic policies of the General Hussain Muhammad Ershad Government (1982-1990), highlighting its emphasis on greater private sector involvement. Under this administration, there was a political inclination towards globalization and deregulation, leading to the appointment of technocrats aligned with this vision. The leadership believed that promoting the private sector would be more effective in job creation. Despite facing significant political opposition, efforts towards disinvestment were made, eventually resulting in compromises like public-private partnerships. The decentralization of administration and restructuring of ministries aimed at promoting industrialization and economic globalization driven by the private sector at the regional level. Initiatives such as the Industrial Promotion and Development Company, with support from organizations like the International Finance Corporation, aimed to boost the private sector. Efforts towards globalization were synchronized with the establishment of an export processing zone in Chittagong, focusing on promoting private and foreign investment. Foreign investment promotion was encouraged through diplomatic efforts and legislative measures to safeguard investors. Currency devaluation was utilized to stimulate exports, along with some degree of import liberalization. The chapter convincingly argues that the groundwork for globalization, initiated under General Zia, came to fruition under General Ershad. The final empirical chapter contends that the system shifted towards globalization and deregulation in 1991. Although a severe balance of payments crisis occurred in 1989, it wasn't perceived as the sole cause of the industrial policy of 1991. The democratic uprising in 1990 led to the downfall of the military-backed government and the rise of a democratic government. The chapter argues that while economic and political changes may have been intertwined, the economic shift in 1991 was primarily driven by ideas within the state and driven by endogenous imperatives. It examines preceding periods to illustrate how the tipping mechanism might have operated, detailing the roles of top technocrats and political executives. The chapter provides insights into key policymakers and their ideas, as well as their interactions with industrialists, entrepreneurs, and representatives of multilateral organizations like the World Bank. Significant reform measures, including tariff reduction, the introduction of value-added tax, banking sector reform, and the adoption of floating exchange rates, are outcomes of the policy change. This research aims to investigate managing information and planning for the participation of health charities. With the Covid-19 outbreak, it was important to use information systems to optimize health management. The correct processing of information is the basis for better use of health charities’ participation. Using the snowball technique, and semi-structured interviews, 47 experts and non-experts in Fars province were asked for their opinions. Next, based on the fuzzy network analysis, important factors were prioritized. Four categories and 8 important criteria (...) were identified. To prioritize the effective aspects of the participation of health charities in Fars province, a network analysis technique was used via MATLAB software. Strategy and programs with a normal weight of 0.34 showed the highest priority. Research and education with a normal weight of 0.26 received the second priority. Laws and regulations with a normal weight of 0.24 were placed as the third priority. With precise planning of health programs, donors see the transparency of decisions. They check the part that needs financing and equipment completion. By proposing a cognitive non-summative account of group belief (GB), I highlight three necessary features at the individual level: commonality, mutuality, and group-based considerations. The passionate and staunch defence of logic of the controversial thinker Ibn Ḥazm, Abū Muḥammad ʿAlī b. Aḥmad b. Saʿīd of Córdoba (384-456/994-1064), had lasting consequences in the Islamic world. Indeed, his book Facilitating the Understanding of the Rules of Logic and Introduction Thereto, with Common Expressions and Juristic Examples (Kitāb al-Taqrīb li-ḥadd al-manṭiq wa-l-mudkhal ilayhi bi-l-alfāẓ al-ʿāmmiyya wa-l-amthila al-fiqhiyya), composed in 1025-1029, was well known and discussed during and after his time; and it paved the way for the studies (...) of his compatriots Ibn Bājjah (d. 1138), Ibn Ṭufayl (1185), and Ibn Rushd (1198), who each gave demonstrative reasoning a privileged place within the methods of attaining knowledge. Unfortunately, as too often in the history of science, Ibn Ḥazm’s innovative perspectives and contributions in logic have been overlooked or considered with an attitude of contempt. On the one hand, his work has been seen, at best, as promulgating the benefits of studying Aristotle’s logic, so that his contribution is assessed as more didactical than conceptual. And on the other hand, those who do examine his innovations often consider them to be mistaken. As indicated by Chejne (1984, p. 2) contempt towards the logical work of Ibn Ḥazm was also present in its reception by the Eastern philosophers who accused him of deviating from Aristotelian logic and of dabbling in things beyond his capability. However, a reassessment of his work on logic has since begun, by delving into the ways the thinker of Córdoba studied the links between deontic and modal qualification of propositions. In this context Lameer’s (2013) paper on the logical sources of Ibn Ḥazm is worth mentioning; the author (p. 417, footnote 1) observes that, although, strictly speaking, it was al-Fārābī who first drew the parallelism between deontic and modal concepts, it was Ibn Ḥazm who developed it and worked it out in a more precise manner. A primary aim of this paper is to help fill some of these gaps by stressing the role of the work of Ibn Ḥazm in developing a notion of deontic necessity deeply rooted in legal normativity, and in explicitly discussing the transference between deontic and modal concepts. According to our view; the basic units of Islamic deontic logic are what we might call, indulging in terminological anachronism, heteronomous imperatives. As it turns out, the heteronomy of imperatives within Islamic legal systems contrasts with those of the purely moral realm, which seem to be closer to an autonomous conception of moral law. There it concurs again with Leibniz’s proposal to define obligatory as “what is necessary for a good person to do”. In the present paper, we will focus on the heteronomous imperatives of legal systems rather than on the imperatives of the purely moral realm. In this context, the work of Ibn Ḥazm extends the parallelism between the necessity of events and that of human actions stressed by his predecessors. According to our understanding, Ibn Ḥazm’s parallelism can be rendered explicit formally by means of a conditional (or hypothetical) structure shared by both deontic and modal propositions. Moreover, this structure makes apparent that this parallelism displays an underlying system of “degrees”. Indeed, while in the domain of events, given some conditions, it makes sense to distinguish between an event that is more likely to happen than another. Ibn Ḥazm speaks of near and distant possibility (such as the higher degree of likelihood of rain, given the condensation of clouds in December, and its lower degree, when the condensation occurs in summer); and, in the domain of actions, the Islamic notion of weighting actions determines degrees of virtue (or of legal and moral value). So whereas the degree of virtue of performing a forbidden act as determined by the distribution of sanction and reward is 0, we obtain the same value by pondering the likelihood of an impossible event to take place. Furthermore, as discussed in section II.3.2, the system of values at work in the parallelism can be seen as opening the way to a more direct correspondence. Thus, while in the realm of nature, likelihood of occurrence of an event is dependent upon the conditions specific to the occurrence of that event; while, in the realm of jurisprudence, likelihood of performing an action is dependent upon the distribution of reward and sanction specific to that action (being that, given the choice to perform or not perform a given action, those that will be rewarded are more likely to be performed than those that are not). According to this perspective, the point of the parallelism is that both deontic and modal qualifications measure the degree of an action or event to become actual; that is – indulging once more in anachronism (but this time from the Leibnizian background) – the degree measures how feasible (facile) an action or event may be. This suggests that Ibn Ḥazm’s perspectives already herald the links to probability and possibility explored by Leibniz six centuries later – see for example Leibniz’s (1671, A VI, I, p. 424-26) use of probability in the context of conditional right. Nevertheless, it also shows a crucial difference to the approach developed in the Elementa Jura Naturalis: whereas Leibniz’s studies seek to define what is to be just or virtuous, the logical system of deontic imperatives within Islamic jurisprudence presupposes that what is to be virtuous has already been settled. Determining what is to be virtuous is not achieved by logical reasoning within the system of legal jurisprudence, but by delving into the higher objectives of the Sharīʿa. While developing our point, we will delve into the logical structure of the heteronomous imperatives. This distinguishes our contribution from the existing literature, such as the papers of Chejne (1984), Lameer (2014), and Guerrero (1997, 2010, 2014), which do not provide a logical analysis of the deontic concepts put into work by Ibn Ḥazm. The true antecedent to the present paper is the work of Farid Zidani (2007, 2015), who, so far as we know, was the first to undertake such a task. Some of our own developments and general epistemological thoughts go beyond Ibn Ḥazm’s framework and motivations; mainly those contained in sections II.3.2 and IV. However, according to our view, these reflections suggest that Ibn Ḥazm’s approach has the substance for a broader and deeper exploration of the logic of norms. The paper is structured as follows:I.Ibn Ḥazm’s Logic of Heteronomous Imperatives. After presenting some extracts of the relevant text, we proceed by providing a formal reconstruction of the five forms of deontic modalities. II. A Landmark in the History of the Logical Analysis of Norms. Duties and Modalities. In this section, we study the transferences from deontic to modal necessity and possibility. We briefly compare the deontic system of Islamic Jurisprudence with that of Leibniz.III. Leibniz and Hypothetical Imperatives in Law.IV. Beyond Ibn Ḥazm: Conclusions and the Work Ahead. We will conclude the paper by discussing briefly some conceptual points that distinguish the logic of heteronomous imperatives from contemporary deontic logic. Our final words will discuss deontic-modal parallelism in the context of Ibn Ḥazm’s rejection of reasoning by conjecture and what we call “the internalization of nature.”. (shrink)

Pain medication is one of the responses to the mercy argument that utilitarian ethicists use for justifying active euthanasia on the grounds of prevention of cruelty and appeal to beneficence. The researcher reinforces the significance of pain medication in meeting this challenge and considers it the most preferred response among various other responses. It is because of its realism and effectiveness. In exploring the mechanism and considerations related to pain medication, the researcher briefly touches the Catholic ethical position on the (...) issue, a position that cannot be ignored in the development of contemporary bioethics. The researcher particularly deliberates on the contemporary Islamic discourse on the issue; by furthering the debate in line with the Islamic legal maxims and general guidance from the primary sources of Islamic law and ethics. The resolution on the issue is sought by synthesizing the views and legal maxims (al-Qawaid al-Fiqhiyyah) on the issue, which in conclusion provide justification for pain medication by considerably regarding pain as necessity and pressing need. However, such resolution allows pain medication to the limit and proportion that removes the pain and prohibits overdosing the patient with medication that may directly cause the death. (shrink)

This study attempts an exposition of different perceptions of obligation to medical treatment that have emerged from the Islamic theological understanding and how they contribute to diversity of options and flexibility in clinical practice. Particularly, an attempt is made to formulate an Islamic perspective on ordinary and extraordinary means of medical treatment. This distinction is of practical significance in clinical practice, and its right understanding is also important to public funded healthcare authorities, guardians of the patients, health and life insurance (...) institutions, and employers who provide health care coverage to their employees. Not only these parties, but also lawyers and justice administration functionaries such as public prosecutors and judges are in need of understanding this distinction to deal with relevant litigations. The distinction could be made regarding terminally ill patients and non-terminally ill patients separately. The essential factors that matter in making the distinction between ordinary and extraordinary means of treatment are: (1) patient capacity (2) expert advice, and (3) nature of medication. Regarding terminally ill patients, medical treatment can become extraordinary because of (1) patient capacity and (2) nature of medication. In both these case the deciding condition applies: the expert advice taken from a group of physicians. In regards to non- terminally ill patients, extraordinary medical treatment includes three cases: (1) treatment that is known to be useless and futile, (2) treatment that endangers the life or cause more harm than what it removes, and (3) useful treatment, but the patient is unable to bear the cost. The standard version of the doctrine of double effect, a significant doctrine in applied ethics particularly medical ethics, not only fails to capture some morally significant components of Aquinas’ view, but it does not resort to proper complementary features in order to accommodate the doctrine to our moral intuitions. We attempt to offer a new formulation of the doctrine incorporating the main components of Aquinas’ view and also to extend the view using some complementary features. Throughout their writings, John McDowell and Richard Rorty draw on Kant’s influential account of experience. For Rorty, Kant is the antagonist who succumbs to foundationalism or what Sellars calls the Myth of the Given and Wittgenstein is the hero who helps in overcoming the siren call of the Myth. McDowell, however, is ambivalent toward Kant. With Sellars, he applauds Kant as the hero who helped us vanquish the Myth of the Given. But he argues that Kant failed to recognize the (...) full strength of his account of experience and capitulated to a subjective idealism. Wittgenstein, for McDowell, is the hero who helps us achieve an account of experience that gets to the things themselves. I adjudicate the philosophical and the exegetical tensions between Rorty and McDowell and support the latter’s approach to experience and to the reading of Kant and Wittgenstein. (shrink)

This paper clarifies the philosophical connection between Al-Ghazali and Descartes, with the goal to articulate similarities and differences in their famous journeys from doubt to certainty. As such, its primary focus is on the chain of their reasoning, starting from their conceptions of truth and doubt arguments, until their arrival at truth. Both philosophers agreed on the ambiguous character of ordinary everyday knowledge and decided to set forth in undermining its foundations. As such, most scholars tend to agree that the (...) doubt arguments used by Descartes and Al-Ghazali are similar, but identify their departures from doubt as radically different: while Descartes found his way out of doubt through the cogito and so reason, Al-Ghazali ended his philosophical journey as a Sufi in a sheer state of passivity, waiting for the truth to be revealed to him by God. This paper proves this is not the case. Under close textual scrutiny and through the use of basic Husserlian-phenomenological concepts, I show that Al-Ghazali's position was misunderstood, thus disclosing his true philosophic nature. Aristotle’s process of constituting the notion of time through Phy., Δ, 10 to Phy., Δ, 12 has the following steps: 1) Time and not-being Since one part of time ‘has been and is not, while the other is going to be and is not yet … one would naturally suppose that what is made up of things which do not exist could have no share in reality.’ (Phy., Δ, 10) 2) Time, divisibility and now We should not regard time as (...) something divisible to parts, some of which belong to past and some other to future. Aristotle argues that ‘if a divisible thing is to exist, it is necessary that, when it exists, all or some of its parts must exist. But of time some parts have been, while others have to be, and no part of it is though it is divisible.’ The last phrase, namely ‘no part of it is’ is based on the fact that ‘what is ‘now’ is not a part.’ The reason being that ‘a part is a measure of the whole, which must be made up of parts. Time, on the other hand, is not held to be made up of ‘nows.’’ (Phy., Δ, 10) 3) Time is not motion Aristotle rejects a general belief based on which time is ‘motion and a kind of change’ because while ‘the change or movement of each thing is only in the thing which changes or where the thing itself which moves or changes may chance to be,’ ‘time is present equally everywhere.’ (Phy., Δ, 10) 4) Time cannot exist without change Although time is not motion or change, it cannot exist without change. One evidence of this, Aristotle says, is the state of our own minds: when it ‘does not change at all or we have not noticed its changing, we do not realize that time has elapsed. Therefore, ‘time is neither movement nor independent of movement.’ (Phy., Δ, 11) 5) Time and before-after Aristotle argues that since ‘before’ and ‘after’ hold primarily in place and in magnitude, they must hold in movement as well due to their correspondence. In fact, ‘the ‘before’ and ‘after’ is identical in substratum with motion, yet differ from it in definition, and is not identical with motion.’ Thereupon, since time and movement correspond wit heach other, they must also hold in time. In fact, there is some kind of unity between motion and before-after: ‘We apprehend time only when we have marked motion, marking it by ‘before’ and ‘after’: and it is only when we have perceived ‘before’ and ‘after’ in motion that we say that time has elapsed. Now we mark them by judging that A and B are different, and that some third thing is intermediate to them. When we think of the extremes as different from the middle and the mind pronounces that the ‘nows’ are two, one before and one after, it is then that we say that there is time, and this that we say is time. For what is bounded by the ‘now’ is thought to be time.’ (Phy., Δ, 11) 6) Time: number of motion in respect of before and after ‘When we perceive the ‘now’ one, and neither as before and after in a motion nor as an identity but in relation to a ‘before’ and an ‘after.’ No item is thought to have elapsed, because there has been no motion either. On the other hand, when we perceive a ‘before’ and an ‘after,’ then we say that there is time. For time is just this- number of motion in respect of ‘before’ and ‘after.’ 7) Time, enumeration and number The consequence of the relation of time and number of motion in respect of before and after is that time is ‘movement in so far as it admits of enumeration.’ A proof of this, Aristotle says, is that ‘we discriminate the more or less by number, but more or less movement by time.’ Therefore, we can say ‘time is a kind of number.’ (Phy., Δ, 11) In this analogy, Aristotle corresponds ‘now’ to the unit of number. ‘If there were no time, there would be no now, and vice versa. Just as the moving body and its locomotion involve each other mutually, so too do the number of the moving body and the number of its locomotion. For the number of the locomotion is time, while the ‘now’ corresponds to the moving body, and is like the unit of the number.’ (Phy., Δ, 11) And this now is not the same during the movement but always different because body carried is different. (Phy., Δ, 11) Aristotle clarifies the sense of number he assigns to time: ‘Time is not number in the sense in which there is ‘number’ of the same point because it is beginning and end, but rather as the extremities of a line from a number, and not as the parts of the line do so… and further because obviously the ‘now’ is no part of time nor the section any part of the movement, any more than the points are parts of the time- for it is two lines that are parts of one line.’ (Phy., Δ, 11) Aristotle distinguishes two senses of now: i) now in the sense of a boundary and ii) now in the sense of number. It is only the second sense of ‘now’ that is time because it is only the second sense that belongs to other things. The first sense belongs only to that which it bounds. (Phy., Δ, 11) 8) Time and measure ‘Not only do we measure the movement by the time, but also the time by the movement because they define each other. The time marks the movement, since it is the number, and the movement the time. We describe the time as much or little, measuring it by the movement, just as we know the number by what is numbered, e.g. the number of the horses by one horse as the unit. (Phy., Δ, 11) Therefore, ‘time is a measure of motion and of being moved, and it measures the motion by determining a motion which will measure exactly the whole motion, as the cubit does the length by determining an amount which will measure out the whole. Mercy is central to the very identity of Islam, yet this is not often recognized by theologians and scholars. This paper will demonstrate that the idea of mercy is important as a prelude to the understanding of Islam and an interpretation of its teachings. This important role of mercy is evident in Islam’s primary sources – the Quran and the Sunnah – and is not contingent on political, social, or historical contexts. It is well recognized that the proper comprehension of (...) Islam hinges on grasping the attributes of God, his divine message, and the character of his messenger. But what is often overlooked is that these aspects are fundamentally rooted in mercy. Islam encourages its followers to cultivate merciful virtues. It emphasizes that the compassionate nature of the faith should always precede the understanding and interpretation of its teachings. As a result, Muslims are encouraged to nurture a compassionate self, foster a benevolent mindset and approach, and anchor their religious obedience in the spirit of mercy. While followers of Islam are responsible for upholding this ethos, external observers too should try to view the religion fairly based upon this recognition of the centrality of mercy. (shrink)

In this paper, an interpretation of "necessity", inspired by a Leibnizian idea and based on the method of dialogical logic, is introduced. The semantic rules corresponding to such an account of necessity are developed, and then some peculiarities, and some potential advantages, of the introduced dialogical explanation, in comparison with the customary explanation offered by the possible worlds semantics, are briefly discussed.

Contrary to nouns and verbs that either do not include a co-positing of parts, including nouns and some verbs, or if they are, their parts do not significate separately, a sentence (λόγος) is a ‘significant portion of speech by co-positing, its parts signify something separately, though not as a positive or negative judgment but as utterance.’ (OI ., I, 4, 16b26-28). Therefore, every utterance in language that i) includes parts, ii) its signification is based on the co-positing of its parts, (...) iii) each of its parts is separately significant but iv) the signification of its parts is the signification of an utterance and not a judgment, is a sentence. This definition distinguishes a sentence from: a) Nouns: because they do not have parts; b) Verbs: because they either do not have parts or if they have, their parts do not significate separately; c) Those co-positings of words whose significance is not based on their co-positing. Thus a co-positing like ‘wall tree house’ is not a sentence because it has no significance on the basis of its co-positing; d) Those co-positings that the signification of at least some of their parts is the signification of judgments. Thus, ‘Socrates is from Athens and is a philosopher’ is not a sentence because at least one of its parts, e.g. ‘Socrates is from Athens’ signifies a judgment. Those sentences that either of truth or falsity belongs to them are propositions (ἀπόφανσις or λόγος ἀπόφαντικὸς). (OI., I, 4, 17a2-3) It is this and only this kind of sentence that is the subject of study in philosophy. (OI., I, 4, 17a5-7) The primary forms of a proposition are, firstly, an affirmation (κατάφασις) and then a negation (ἀπόφασις). (OI., I, 4, 17a8-9) To have an affirmation or a denial and, thus, a proposition, what firstly is necessary is a verb or the tense of a verb (OI, I, 4, 17a9-12; I, 10, 19b12-13; OI, I, 4, 16b28-30) and a noun (OI, I, 10, 19b10-12). Aristotle draws a contrast between single and plural proposition: a) Single proposition: a proposition that ‘indicate a single fact, or the conjunction of the parts of which results in unity.’ (OI., I, 5, 17a15-16) b) Plural propositions: a proposition that ‘are separate and many in number, which indicate many facts, or whose parts have no conjunction.’ (OI., I, 5, 17a16-17) He also differentiates between simple and composite propositions (OI, I, 5, 17a20-22): a) Simple proposition: ‘that which asserts or denies something of something’; b) Composite propositions: ‘that which is compounded of simple propositions.’ A simple (ἁπλῆ) proposition is a statement about the belonging or not belonging of something (OI, I, 5, 17a22-24). Affirmation and denial are indeed kinds of simple proposition, one affirming the belonging and the other not belonging. An affirmation or denial may be single or non-single. A single affirmation or denial ‘signifies some one fact about some one subject. This singularity is destroyed neither by the universality of subject nor by the universal character of the statement. The only thing that destroys this singularity is that one part signifies more than one thing, which makes the proposition more than one proposition (OI, I, 8, 18a13-27). In other words, neither ‘predication of one thing of many subjects’ nor ‘many things of the same subject’ results in a unitary proposition. (OI., II, 11, 20b13-16) There is also another cause that might destroy the unity of predicate and thus the unity of proposition, namely when one of the parts of the predicate is implicit in the other. Thus, e.g. animal-man does not form a unity because the notion ‘animal’ is implicit in ‘man.’ (OI., II, 11, 21a16-18) The following are characteristics of propositions: 1. That about which an affirmation signifies something is a noun, whether definite or indefinite. (OI., I, 10, 19b5-12) Moreover, there can be no affirmation or denial without a verb. (OI., I, 10, 19b12-19) Therefore, a proposition must involve at least a noun and a verb. 2. Contrary propositions: since both belonging and not belonging of something to something is possible, we are able to make a negative proposition out of an affirmative one and vice versa. (OI., I, 5, 17a26-31) Therefore, ‘every affirmation has an opposite denial’ and vice versa. (OI., I, 6, 17a31-33) The contradictory of each proposition is made by changing the positivity or negativity of the verb ‘to be’ to its opposite but not by changing the subject to its opposite. Thus, the contradictory of ‘man is white’ is ‘man is not white’ and not ‘not-man is white.’ (OI., II, 11, 21a38-b5) What happens in the mentioned wrong form of contradictory propositions is that they change the subject while the denial must be the contrary of the affirmation about the same subject. (cf. OI., II, 14, 24b1-6) This is made plain in propositions involving a verb other than ‘to be’. What must be changed in these propositions is the verb and not the noun or the subject. Thus, the contradictory of ‘Socrates runs’ is ‘Socrates does not run’ and not ‘not-Socrates runs.’ 3. Conversion possible: ‘Out of conversion (μετατιθεμένου) of the name and the verb, the same affirmation and denial is generated. (OI., I, 10, 20b10-12) In other words, the two affirmations or denials ‘signify the same thing.’ (OI, I, 10, 20b1-2) . (shrink)

Patient autonomy has a critical role in making decisions in medical practice and it is accepted by international conventions on health care and various national medical codes. However, pertaining to terminally ill patients, this right becomes very problematic in regards to end of life decisions. Utilitarian ethicists motivated by materialistic worldview and individualism have made patient autonomy based arguments for the permissibility of active euthanasia. The best interest and golden rule arguments are based on subjective moral judgment thus failing the universalization test. In the article of Bueno titled “Davidson and Skepticism: How Not to Respond to the Skeptic,” he intends to demonstrate that although Davidson’s theory of Coherence holds many attractions, it does not entail a response to any kinds of skepticism including Global, Lottery, and Pyrrhonian. In this study, the goal is to criticize the work of Prof. Bueno in connection with two criticisms raised by him over Davidson’s anti-skeptical strategy. Further, by giving some reasons in favor of Davidson’s anti-skepticism argument, (...) it will be shown that neither the above stated criticisms nor the global skepticism response could undermine the validity of anti-skepticism argument. The practice of assigning authorship for a scientific publication tends to raise two normative questions: 1) ‘who should be credited as an author?’; 2) ‘who should not be credited as an author but should still be acknowledged?’. With the publication of the revised version of The European Code of Conduct for Research Integrity (ECCRI), standard answers to these questions have been called into question. This article examines the ways in which the ECCRI approaches these two questions and compares these approaches (...) to standard definitions of ‘authorship’ and ‘acknowledgment’ in guidelines issued by the International Committee of Medical Journal Editors (ICMJE) and the World Association of Medical Editors (WAME). In light of two scenarios and the problems posed by these kinds of ‘real-world’ examples, we recommend specific revisions to the content of the ECCRI in order not only to provide a more detailed account of the tasks deserving of acknowledgment, but to improve the Code’s current definition of authorship. The experiments in Quantum mechanics says the subatomic reality is subjective. The author argues that the large scale universe is also subjective. The Ptolemaic universe is complementary of the Copernican universe. In a previous reality the universe was Ptolemaic and the man was son of Adam , but when man observed the heavens with telescopes the reality shifted , it has become Copernican. The Copernican universe contains heliolatry inside it . This heliolatry forces man to become sons of the apes.

Turing does not provide an explanation for substituting the original question of his test – i.e., “Can machines think?” with “Can a machine pass the imitation game?” – resulting in an argumentative gap in his main thesis. Aristotle discusses divine intellect in Metaphysics XII.9. This chapter, however, seems incomplete, as a question posed in it (1074b36–8) remains unaddressed. On the other hand, there is another passage (1072b14–30) in Metaphysics XII.7 that seems to address a similar topic. Nevertheless, the latter passage appears, in several respects, to be extraneous to its present chapter. This article argues that the placement of the aforementioned passage within Metaphysics XII.7 is incorrect, and its original position is actually at the end of Metaphysics (...) XII.9. This alternative reading not only offers a better understanding of 1072b14–30 but also has the potential to finalize the unfinished discussion in Metaphysics XII.9. (shrink)

Education is crucial to the overall development of all communities. Since the early days of Greek philosophy, philosophers have made significant contributions to the advancement of education for both individuals and the states. Greek philosophers, notably Plato, emphasized the importance and relevance of education for his conceptual ideal state. His educational ideas were rooted in his philosophy, notably idealism, and it continues to have a great effect, particularly on education. Idealism focuses on ideas and believes that genuine knowledge can be (...) found in the ideas' world. His age-based educational system advocates both public education and equal access. The purpose of this paper is to revisit his educational ideas in depth and have a better understanding of them in terms of contemporary education. This paper adopts an analytical strategy to achieve its purposes, and it maintains, based on secondary evidence, that the features of the educational ideas of Plato are truly pertinent and might be applied to contemporary education after appropriate integration. Dialectic has been a fundamental part of philosophy since the time of Anaximander, which is a method of argumentation and reasoning. Anaximander’s thought is deeply rooted in the Milesian school of philosophy, where philosophers used dialectic to explore and explain life and the world. This philosophical method focuses on the idea of opposites and how they interact and influence each other to create a more complete understanding of the ideas. The presence of dialectic in Anaximander’s philosophy is evident in his (...) Apeiron which allowed him to challenge and question existing ideas. This article will explore the role of dialectic in Anaximander’s philosophy, including an analysis of his Apeiron and how it shaped his philosophical ideas. To reach its conclusion, this article applies an analytical approach and depends on secondary sources of data. By studying Anaximander’s philosophy through a dialectical lens, we can gain a deeper appreciation for his contributions to Western philosophy as well as to the realm of knowledge. (shrink)

در اين مقاله تلاش مي‌كنیم روايت ارسطو از پيش‌سقراطيان را بر اساس متون خود ارسطو و عمدتاً با استفاده از كتاب‌هاي متافيزيك، فيزيك و كون و فساد مورد بررسي قرار دهیم و نشان دهيم چگونه ارسطو همه پيش‌سقراطيان را به يك نحو و بر مبناي چهارچوب فلسفه خودتفسير مي‌كند. او آرخه پيش‌سقراطي را به معناي عنصر يعني امري بسيط كه خود از چيز ديگري نيست و همه چيز از آن تركيب شده است، تفسير مي كند و حتي آن را به (...) عنوان جوهر و هر چيز ديگر را به عنوان عرض در نظرمي گيرد و تمايز آرخه و اشياء را بر مبناي اين تقابل در فلسفه خود مورد تفسير قرار مي‌دهد. ارسطو همچنين نگاه پیش سقراطیان به تغییر را بر مبناي تمايز خود ميان تغيير و كون و فساد تحليل مي‌كند. همه اين موارد نشانگر آن هستند که ارسطو پیش سقراطیان را ارسطوئی و بر مبنای اندیشه خود تفسیر کرده است. در اين صورت، با توجه به اينكه ارسطو از اولين و مهم ترين منابع انديشه هاي پيش سقراطيان است، در بررسي آنها همواره بايد نقش ارسطو را مد نظر قرار داد. The overall objective of the study was to examine the pros and cons of the participatory approach adopted in natural resource management in the ecologically protected areas of the Sundarbans mangrove of Bangladesh. A comparative study was done between the people who are involved and non-involved in this approach. Empirical data was collected through personal interviews with a structured questionnaire. The Gini coefficient was measured first and then embedded with the Lorenz curve to draw a line between perfect equality and (...) inequality vis-a-vis. The study revealed that the co-management built awareness in favor of biodiversity conservation and the efficient use of natural resources. Contradictorily, a segment of different hierarchical committees was involved in destructive activities like poisoning the wetlands for fishing. Therefore, a mixed outcome was found. The findings will help the policymakers in identifying the pitfalls and bottlenecks rooted in co-management. Hence, the study recommends revising the approach to ensure the community’s active participation on an equal basis and take action against them who degrade those resources. Exploring profitable alternative income-generating activities is warranted to narrow down the dependency on the Sundarbans mangrove’s natural resources. In order to address the tragedy of the commons, the study advocates for the unity of all knowledge ranging from science to humanistic scholarship for sound policymaking. (shrink)

در اين جستار برآنيم كه ترتيبي جديد از محاورات افلاطون ارائه نمائيم؛ ترتيبي كه بر مبناي توسعه وجودشناختي و معرفت شناختي افلاطون مبتني است و تفاوت‌هاي اساسي با كرونولوژي غالب امروزي محاورات دارد. در حاليكه در همه كرونولوژي هاي پذيرفته شده فعلي، پارمنيدس به عنوان نقد نظريه مثال در محاورات مياني و بنابراين متأخر از اين محاورات در نظر گرفته مي‌شود، كرونولوژي پيشنهادي ما پارمنيدس را پس از محاورات اوليه و پيش از محاورات مياني قرار مي‌دهد. بر اساس اين تغيير (...) نه تنها منون، فايدون، فايدروس و جمهوري پس از پارمنيدس قرار مي‌گيرند، بلكه ميان ثئايتتوس و سوفيست از يك طرف و فايدون و جمهوري از طرف ديگر، فاصله زيادي ايجاد مي‌شود به طوري كه منون و فايدون ميان جفت اول و سوفيست و تيمايوس ميان جفت دوم قرار مي‌گيرند. در اين جستار نشان خواهيم داد كه چگونه اين تغييرات مي‌توانند به خوانشي سازگارتر از محاورات مياني و متأخر كمك كنند و در عين حال از بسياري مشكلات ناشي از كرونولوژي‌هاي ديگر بپرهيزند. This paper reports on the hospitality management competencies required to be assigned to a management position in Turkey. The study found out a number of competencies with top priority ranging from 82.1 to 21.4 percent extracted from job ads on the most browsed career websites in Turkey by employing a content analysis as the research method. These core competencies were delineated in the five domains of Sandwith’s Competency Domain Model in order to discover how they pertained to the theory. The (...) in-depth analysis rendered the whole range of domains particularly leadership, technical and interpersonal, partly conceptual/creative and administrative.
